Terms of Service

Applies to the MyRunTime website, race photo gallery, registration, timing and results services.

Effective: October 2026 | Last updated: September 30, 2026

Welcome to MyRunTime. These Terms of Service (the "Terms") govern your access to and use of the MyRunTime website and related digital services, including our race photo gallery, online registration, race timing, results, and participant tools (together, the "Services"). Our Privacy Policy explains how we handle personal data and forms part of these Terms.

The Services are operated by Itemhound Corporation, a corporation organized under the laws of the Republic of the Philippines, with its registered business address at 702-703, 140 Kalayaan Ave, Central, Quezon City. In these Terms, "MyRunTime", "we", "our" and "us" mean Itemhound Corporation as operator of the Services.

1. Acceptance of These Terms

By accessing the MyRunTime website, searching, viewing, downloading, or sharing photos, registering for an event, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Event organizers may add event-specific conditions, which form part of these Terms for that event. If you use the Services on behalf of an organizer, company or other entity, you confirm that you have authority to bind it. These Terms were written in English, and the English version controls over any translation.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to register for an event or make payments through the Services. Anyone may browse the public race photo gallery, but a minor should do so with the knowledge of a parent or guardian. Parents and guardians are responsible for the activities of any minor they permit to use the Services, including registration of minors in events.

  • Registering a minor. A parent or legal guardian must complete the registration of any participant under 18. By doing so, they confirm that they are the parent or legal guardian, that they are authorized to accept these Terms and the Privacy Policy for the minor, and that they have read them.
  • Photos of minors. Photos of minors appear in the gallery but are never used for promotion and are removed within 48 hours of a request.

3. The MyRunTime Race Photo Service

MyRunTime hosts race photos taken at events on the MyRunTime website so that participants can find and keep their own photos.

  • Free search, download and sharing. Searching by bib number, downloading, and sharing your photos is free, subject to these Terms.
  • Public gallery. The event gallery is public. Anyone who enters a valid bib number for that event can view, download, and share the photos tagged with that number, whether or not they are that participant. We do not display names beside gallery photos, and we ask search engines not to index gallery pages. By registering, you acknowledge that photos of you taken at the event will appear in the gallery, and that you may opt out or ask for removal at any time (Section 8).
  • How photos are found. Photos are tagged with bib numbers, using automated detection and, where available, timing data. MyRunTime does not use facial recognition.
  • No guarantee of coverage or accuracy. We do not promise that every participant was photographed, that every photo will be tagged, or that tagging will be correct. Some photos may be missing, mis-tagged or delayed.
  • Availability period. Photos are generally available for up to 12 months after an event, as stated in our Privacy Policy, and may be removed earlier for the reasons in these Terms.
  • Changes. We may add, change, limit, or end features, including optional paid features such as prints or premium files. If we do, we will tell you before you are charged, and free access to the standard photos described here will not be turned into a charge without prior notice.

4. Searching for Photos

Photos are located by event and bib number. When you search, you agree that you will:

  • search only for your own bib number, or the bib number of a person who has asked you to look, or of a minor for whom you are the parent or guardian;
  • not run systematic, repeated or automated searches to collect photos of other participants, for example by trying bib numbers in sequence; and
  • not use search results to identify, track, harass, profile or contact any person.

We may apply rate limits, block suspicious activity, and restrict access to protect participants and the Services.

5. Downloading and Sharing Photos

Your license

Subject to these Terms, MyRunTime grants you a free, personal, non-exclusive, non-transferable, non-sublicensable and revocable license to download, store, print and share the photos in which you appear, or in which a person you are permitted to search for under Section 4 appears, for personal and non-commercial purposes. The photos are licensed to you, not sold. You do not gain ownership of them or copyright in them.

What you may do

  • Keep the photo on your devices and print it for yourself, family, and friends.
  • Post or share it on your own personal social media or messaging apps and use the share tools we provide.
  • Tag or credit MyRunTime and the photographer where a credit line is shown.

What you may not do

  • Sell, license, sublet or otherwise commercialize a photo, or use it in advertising, sponsorship, merchandise, or promotions, without our prior written permission (and the rights holder's, where different).
  • Remove, crop out, hide or alter watermarks, logos, credits, copyright notices, or metadata.
  • Edit a photo in a misleading, defamatory, demeaning, or offensive way, or present it as a photo you took.
  • Use photos to train, fine-tune, or test machine learning, facial recognition or biometric systems.
  • Download photos of other people in bulk, or use photos of other people in a way that harasses, embarrasses or endangers them.

If a photo shows other participants, please be considerate of them, and take it down if they reasonably ask. If you want to use a photo commercially, write to us at dataprivacy@itemhound.com to request permission.

6. Ownership of Photos and Content

Photographers, MyRunTime, or the relevant event organizer (as agreed between them) own or hold the rights to the photos on the Services. Nothing in these Terms transfers ownership to you.

When you register for an event through MyRunTime, you acknowledge that:

  • official photographers will take photos at the event, and photos in which you appear (with your bib number visible or matched to you through timing data) will be uploaded to the MyRunTime event gallery;
  • the gallery is public: anyone who enters your bib number for that event can view, download and share photos tagged with it;
  • photos are stored and delivered using cloud providers, including Cloudflare in the Asia-Pacific region, as explained in our Privacy Policy;
  • photos are generally available for up to 12 months after the event; and
  • you can opt out of the gallery when you register or at any time afterwards, and you can ask us to remove any photo of you, free of charge, under Section 8.

7. Photographers and Contributors

If you supply photos to MyRunTime, whether as an official event photographer or a contributor, you represent and warrant that:

  • you took the photos or otherwise have all rights needed to give us the license below;
  • you have the accreditation, permissions, and access required by the event organizer and venue, and you comply with the organizer's media rules and any exclusivity terms;
  • the photos were lawfully taken, do not infringe any person's privacy or intellectual property rights, and are not obscene, defamatory, or unlawful;
  • treat photos of minors with particular care
  • act on a removal request within 24 hours of our notice; and delete their own copies when the retention period for that event ends unless we agree otherwise in writing.

You grant MyRunTime a worldwide, non-exclusive, royalty-free license (sublicensable to event organizers and service providers as needed) to host, store, reproduce, display, process, tag, and index the photos, to create previews and thumbnails, to let participants download and share them under Section 5, and to use them to promote the Services and the event. Unless a separate written agreement says otherwise, you keep the copyright in your photos. You agree to indemnify MyRunTime against claims arising from a breach of these warranties.

8. Content Moderation and Photo Removal

We may review, hide, or remove photos and other content at our discretion to enforce our content standards, including content that is inappropriate, sexually suggestive, obscene, vulgar, indecent, harmful, or incorrectly tagged.

Separately, participants may request the removal of their photos or exercise their applicable data privacy rights under the Data Privacy Act of 2012. Such requests will be handled in accordance with applicable data privacy laws and our Privacy Policy, regardless of whether the photo violates our content standards.

If you appear in a photo and want it removed, email dataprivacy@itemhound.com as described in Section 12 of our Privacy Policy. Removal applies to the MyRunTime website, and requests are free. It cannot recall copies that have already been downloaded or shared by others.

Additionally, you may opt out of the public gallery at any time, before or after the event, by emailing dataprivacy@itemhound.com with the subject “Gallery Opt-Out” and your event name and bib number. We will not publish photos tagged with your bib number, will remove any already published, and will keep your bib number for that event on a suppression list so that photos uploaded later are not published. Opting out is free and does not affect your registration or results.

We acknowledge photo removal requests within two (2) business days and remove the photo from public view within five (5) business days of confirming the request. For a participant under 18, we remove the photo from public view within 48 hours of confirming the request. Removal includes purging the photo and its thumbnails from our content delivery network cache. We will confirm by email when the request is done. If we decline a request, we will tell you why and that you may complain to the National Privacy Commission.

Other takedown requests. To report a photo that is harassing, defamatory, unsafe, or otherwise unlawful, email the same address with the link and the reason. We may hide the photo while we review it.

9. Registration and Payments

Some Services, such as online event registration, require you to answer a registration form. If you use them, you agree to provide true, accurate, current, and complete information, and to keep it up to date.

  • Registration is personal. It is non-transferable and subject to the event organizer's approval, terms, waivers, and policies. MyRunTime is a technology provider and does not decide eligibility, categories, giveaways, or transfers.
  • Sharing of registration data. We share registration data, such as your name, date of birth, gender, contact details, singlet/shirt size, bib number, and race category with the event organizer to manage the event, verify payment, time the race, and publish results.
  • Payments. Event fees and charges are shown at checkout. By completing your registration, you authorize MyRunTime or its payment partners to charge the amount shown. MyRunTime collects payments on behalf of the organizer.
  • Refunds. Payments are non-refundable unless the event organizer authorizes a refund or the law requires one. MyRunTime does not decide on refund requests on behalf of the organizer.
  • Failed or disputed payments. We may withhold access to registration or event participation until the issue is resolved.
  • Promotions and discounts. No discount, rebate, or credit applies unless MyRunTime or the organizer announces it through official channels in writing.

10. Race Results and Data Integrity

We work to keep timing and results accurate, though these may be affected by participant behavior, weather, equipment issues, or fortuitous events. You agree not to tamper with timing chips, bibs, or data transmitted through our systems. Deliberate manipulation or false reporting may result in the invalidation of results and disqualification from future events.

Official results, including your name, bib number, category, and finish time, are published and may be publicly accessible.

11. Acceptable Use

You agree not to:

  • use the Services for anything unlawful, or in a way that infringes the rights or violates the privacy of others;
  • scrape, crawl, harvest, or bulk download data or photos, or use bots or other automated tools without our written permission;
  • circumvent watermarks, rate limits, access controls, or other security features, or probe or attack the Services;
  • upload malicious code, or interfere with the operation of the Services or other users' use of them;
  • impersonate another person or misrepresent your identity or your relationship with an event; or
  • reverse engineer, decompile, or attempt to discover the source code or algorithms of the Services.

12. Intellectual Property of MyRunTime

The Services, including the website, software, databases, tagging and search technology, timing and registration systems, designs and aggregated race data, and the name and logo MyRunTime, belong to MyRunTime or its licensors and are protected by intellectual property laws. Except for the licenses expressly given in these Terms, we reserve all rights. You may not use our name, logo, or trademarks without written permission. Third-party names, logos, and event brands displayed on the Services belong to their owners, and their appearance does not mean endorsement or partnership unless we say so.

13. Claims of Infringement

MyRunTime respects intellectual property rights and handles infringement complaints under this Section in line with the Intellectual Property Code of the Philippines (Republic Act No. 8293, as amended). If you believe material on the Services infringes your copyright or trademark, send a written notice to the address in Section 24 that includes:

  1. your full name, address, telephone number and email address;
  2. your physical or electronic signature, or that of a person authorized to act for the rights owner;
  3. a description of the work or mark you say is infringed;
  4. enough information to locate the material on the Services, such as the event name, link, or screenshot;
  5. a statement that you believe in good faith that the use is not authorized by the rights owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights owner or authorized to act for the owner.

Incomplete notices may not be processed. If material was removed by mistake or misidentification, you may send a counternotice with your contact details, identification of the material and its former location, a good-faith statement under penalty of perjury, and your signature. After a valid counternotice, we may restore the material unless the complainant tells us within a reasonable time that it has started legal action. False or malicious claims may carry penalties under Philippine law. We suggest you consult your own legal counsel before sending a notice.

14. Event Organizers

Accounts are available only to event organizers, through the MyRunTime organizer portal. Organizers are responsible for keeping their login credentials confidential, for all activity under their accounts, and for telling us promptly at dataprivacy@itemhound.com for any unauthorized use. If you are an event organizer using the Services, you represent that you:

  • are authorized to collect participant data and payments through the platform, and have given participants the notices and obtained the permissions and consents required by law, including for photography at your event and any use of their photos;
  • authorize MyRunTime to process registration, payment, timing, results, and photo data on your behalf;
  • include the photography and gallery notice in Section 6 in their participation terms and registration flow;
  • forward any photo or privacy request they receive to dataprivacy@itemhound.com within two (2) business days;
  • contact participants using data obtained through MyRunTime only as allowed by the participant’s recorded choices;
  • permit MyRunTime to use your event name, logo, and visual assets for race listings, galleries, and promotional materials; and
  • will indemnify MyRunTime against disputes arising from your mismanagement, cancellation, or modification of an event, refund claims, or a breach of these representations.

15. Third-Party Services

The Services rely on and may link to third-party services such as hosting providers, payment gateways, mapping, analytics, and social media platforms.

We do not control them and are not responsible for their availability, accuracy, security, or content. Your use of them is subject to their own terms.

16. Disclaimers

MyRunTime provides the Services on an "as is" and "as available" basis, without warranties of any kind, express or implied, to the extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free, that every participant will be photographed or every photo correctly tagged, that timing data or results will be perfectly accurate, or that any error will be corrected within a set time. Weather, signal interference, user error, device incompatibility, server downtime, and network delays may affect performance.

MyRunTime is a race technology provider. Unless we expressly say we are the organizer, we do not organize events and are not responsible for event postponements, cancellations or changes, injuries, losses, or damages incurred while taking part in an event.

17. Limitation of Liability

To the fullest extent permitted by law, MyRunTime, Itemhound Corporation and their officers, employees, and affiliates will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, data, or opportunities, arising from your use of, or inability to use, the Services. Their total liability for any claim relating to the Services is limited to the amount you paid to MyRunTime for the specific Service that gave rise to the claim. Where the Service is free, such as the race photo gallery, liability is limited to the extent the law allows.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Philippine law, including liability for fraud, willful misconduct or gross negligence, or your rights as a consumer or data subject under the Consumer Act of the Philippines (Republic Act No. 7394), the Internet Transactions Act of 2023 (Republic Act No. 11967) and the Data Privacy Act of 2012 (Republic Act No. 10173).

18. Indemnity

You agree to indemnify and hold harmless MyRunTime, Itemhound Corporation, and their officers, employees, and affiliates against claims, losses, and reasonable expenses to the extent directly caused by your willful misconduct, negligence, or material breach of these Terms, including misuse of downloaded photos, content you submit, or violation of another person's rights.

This obligation applies primarily to organizers, photographers, and other commercial users, as appropriate, and is limited to losses attributable to their acts or omissions.

19. Suspension and Termination

We may suspend, restrict, or end your access to the Services, with or without notice, if you breach these Terms, misuse the Services or the photos, put other people, events, or the Services at risk, or where required by law. Runners do not need an account to use the Services, so you may stop using them at any time. Event organizers who hold an account on the MyRunTime organizer portal may close that account by writing to us at dataprivacy@itemhound.com. Ending your access does not affect rights or obligations that arose earlier, or provisions meant to survive, such as ownership, disclaimers, limits of liability, and indemnity.

20. Privacy

How we collect and use personal data, including race photos, bib numbers, and search activity, is described in our Privacy Policy. By using the Services, you acknowledge that you have read and understood the policy.

21. Feedback

If you send us comments or suggestions, you agree that we may use them to improve or promote the Services without payment or obligation to you, and you grant us a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to do so. Please do not send anything you want to keep confidential.

22. Governing Law and Disputes

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. If a dispute arises, please contact us first, and we will make a good-faith effort to resolve it within thirty (30) days.

Where appropriate, the parties may agree to mediation or other alternative dispute resolution methods before pursuing litigation. If the dispute remains unresolved, either party may bring the matter before the proper courts of the Philippines. Individual users retain their rights to seek remedies through applicable consumer protection channels, including the Department of Trade and Industry (DTI), the National Privacy Commission (NPC), or other government agencies with jurisdiction over the matter.

23. General

  • Entire agreement. These Terms, the Privacy Policy, and any event-specific conditions are the whole agreement between you and MyRunTime about the Services.
  • No partnership. These Terms do not create a partnership, joint venture, joint controllership, employment, or agency relationship.
  • Waiver and severability. If we do not enforce a right, we have not given it up. If a provision is found unenforceable, the rest remain in force.
  • Assignment. You may not assign these Terms without our written consent. We may assign them to an affiliate or successor and may use contractors and service providers to deliver the Services.
  • Notices. We may give notice by email, on the website, or within the Services.
  • Changes. We may update these Terms from time to time. Any revised Terms will be posted with an updated effective date, and we will provide notice of material changes before they take effect. Your continued use of the Services after the changes take effect constitutes acceptance of the updated Terms. Any changes that expand how we collect, use, or share your personal data will be communicated to you in advance and, where required by law, will take effect only after obtaining your consent.
  • Headings. Headings are for convenience only.
